"Declaring a state of emergency in the country for this purpose would be a mistake on the part of the President. The state emergency law was intended to be used for major natural disasters or bloody events, such as the attacks on our country on 11 September.

“Such a Declaration will undermine the role of the Congress and the process of allocation of funds, it is elementary not quite a good politician. This makes it a bad fact for future presidents—both democratic and Republican-who have every chance to try to apply the same maneuver in order to circumvent the Congress to promote their own political goals. It still contains an unseemly constitutional character and is almost likely to be challenged in the courts.
